A court has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement is without lawful basis.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.
The case originates in a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an mistake. After his return to the United States to face alien smuggling allegations, he was detained in immigration detention.
In her order, the judge noted that the authorities does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
The court challenge center on disputed claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.
He has also entered a not guilty plea to the smuggling counts, which are part of a separate criminal case in the state of Tennessee.
The court, who was hearing his petition to deportation in a federal court, ruled that he must now comply with the terms of his bond from custody in Tennessee. This decision effectively transfers his supervision to the Tennessee court.
